This bill would change federal gun laws to spell out who counts as a “resident” of a state for firearm purchase and background check purposes. It says a person generally lives in a state if they are there and intend to make a home there, and it also covers people who split time between more than one state, active-duty military members, and people without a physical home in any state but who use a private mailbox or post office box. The bill would also require that, for the national background check system, the buyer’s ID show either a home address or, if they do not have a physical residence in any state, a private mailbox or post office box address.
- It adds new definitions for “state of residence” and “resident” to federal gun law.
- Active-duty military members could count as residents of the state where their duty station is located, or where they live while commuting to that station.
- A person who has homes in more than one state could be treated as a resident of each state while they are present in that state.
- It changes background check rules so identification can show a home address or, in some cases, a private mailbox or post office box address.
Official Summaries
Traveler's Gun Rights Act
This bill broadens the scope of allowable firearms transactions involving active duty servicemembers and their spouses and individuals who do not have a residence in any state.
Currently, federal firearms laws generally prohibit a federal firearms licensee (e.g., a gun dealer) from selling or delivering a firearm to an individual whose state of residence is different than the state where the licensee's place of business is located.
This bill defines the term state of residence as the state in which an individual is present with an intention of making a home.
In the case of an individual who does not have a physical residence in any state, the term state of residence means the address of the individual's private mailbox or post office box.
In the case of a member of the Armed Forces on active duty, or his or her spouse, the term state of residence means (1) the state in which the member's permanent duty station is located, and (2) the state where the member maintains a place of abode from which he or she commutes to the permanent duty station.
